After his sixth drunk driving offense, Robert J. Kent Vandyke will likely take another trip to prison.
After two hours of deliberation, the eight-member jury returned with a guilty verdict against the 42-year-old Springville resident.
Vandyke's offense of driving under the influence is usually classified as a class B misdemeanor, but it was increased to a third-degree felony by Judge Claudia Laycock in consideration of Vandyke's three previous DUI-related felony charges in the past 10 years.
Vandyke will return to Laycock's courtroom on May 28 for sentencing. Prosecutors are expected to push for the maximum sentencing of 5 years.
Vandyke has been convicted of five previous drunk driving offenses in the last 10 years. He spent four and a half of those years in prison after killing a 36-year-old woman and injuring her 12-year-old daughter in a drunk driving accident.
In the latest incident, Vandyke was pulled over in September of 2007 after police received reports of a possible drunk driving situation. Vandyke refused to take breath, blood and urine tests and pleaded his Fifth Amendment rights.
Vandyke began his two-day jury trial on Monday morning and sat stone faced during the proceedings.
State prosecutor Craig Johnson gave his closing arguments before the jury on Tuesday morning.
